TTC celebrating 100 years of moving Toronto

1.Contest Period

The Contest begins on April 4, 2022 at 08:00 AM Eastern Time (ET) and ends on May 15, 2022 at 11:59 PM ET (the “Contest Period”).  The Contest Period consists of forty-two (42) calendar days.

2.Eligibility Requirements

(a)The Contest is open to any student who is registered in a secondary school or elementary school within a school board in the Province of Ontario.

(b)Students who are children of or under the guardianship of an employee (including regular full-time, regular part-time, temporary full-time, temporary part-time, student full-time, student part-time, co-op, casual, and fixed term) of TTC are not eligible to enter the Contest.

3.How to Enter

(a)No purchase necessary.

(b)A contestant may enter and participate in the Contest as an individual (“Individual Contestant”), as part of group made of a minimum of two (2) students to a maximum of four (4) students who are all registered in the same school class (“Group Contestant”), or as an Individual Contestant and as part of a Group Contestant.

(c)To enter and participate in the Contest, the following must occur:

i.If an Individual Contestant, submit name, grade, phone number or email address, and mailing address.  If a Group Contestant, submit the name, phone number or email address, and mailing address of each student in the group, and the group grade.

ii.If contestant is under the age of eighteen (18) years of age on the Submission Deadline, submit the Permission Form (located at ttc.ca/ttc100) completed and signed by the parent or guardian of contestant which permits contestant to enter and participate in the Contest (“Permission Form”).

iii.Each Individual Contestant and each Group Contestant will fall into one of the following categories (each a “Contestant Category”):

A.Junior kindergarten to grade 4 (the “JK4 Contestant Category”).

B.Grade 5 to grade 8 (the “5-8 Contestant Category”).

C.Grade 9 to grade 12 (the “9-12 Contestant Category”).

D.Each Individual Contestant and each Group Contestant may submit one (1) of a drawing, a sketch, a painting, or a written description (each an “Entry”, more than one are and collectively, “Entries”) as noted in each of the following categories (each an “Entry Category”, collectively, “Entry Categories”):

I.Drawing, sketch, or painting of TTC vehicle in one hundred (100) years (the “Vehicle Entry Category”).
II.Drawing, sketch, or painting of TTC infrastructure in one hundred (100) years (the “Infrastructure Entry Category”).
III.Drawing, sketch, or painting of TTC safety requirements in one hundred (100) years (the “Safety Entry Category”).
IV.Drawing, sketch, or painting of TTC system expansion in one hundread (100) years (the “Expansion Entry Category”).
V.Drawing, sketch, painting, or written descripton of TTC customers in one hundred (100) years (the “People Entry Category”).

(v)State the Entry Category the Entry falls under.

(vi)The drawing, sketch, or painting Entry shall be a maximum of 11 inches by 17 inches paper, and the written description Entry shall be on one (1) 11 inches by 8.5 inches paper and be in Arial font, size 12 font, single spaced, and a maximum of 500 words.

(vii)The Entry must,

(A)be original to the Individual Contestant or Group Contestant; and
(B)not be defamatory, libelous, obscene, and not contain, depict, discuss or otherwise involve, without limitation, nudity, alcohol/drug consumption or smoking, explicit or graphic sexual activity, or sexual innuendo, crude, vulgar or offensive language and/or symbols, derogatory characterizations of any ethnic, racial or, sexual, religious or other groups, content that endorses, condones and/or discusses any illegal behaviour, personal information of individuals, commercial messages, comparisons or solicitations for products or services (other than TTC’s), any identifiable third party products, trade-marks, brands and/or logos (unless the appropriate consents have been obtained).

(viii)Submit each Entry and Permission Form (if applicable) by email or regular mail as follows:

A.If by email, to the email address ttcttc100contest@ttc.ca (the “Email Portal”).  Drawing, sketch, painting, and written description Entry shall be in PDF or JPEG format, and the Permission Form (if applicable) shall be in PDF format.
B.If by regular mail, to the following address (the “Mail Address”):

(ix)Contestant must be in compliance with these Rules.

5.Submission Deadline

All Entries are to be submitted to the Email Portal or receieved at the Mail Address by May 15, 2022 at 11:59 PM ET (the “Submission Deadline”).

6.Entry Limits

(a)An Individual Contestant may submit a maximum of one (1) Entry for each Entry Category, for a maximum of five (5) Entries, in accordance with these Rules, and a Group Contestant may submit a maximum of one (1) Entry for Each Category, for a maximum of five (5) Entries, in accordance with these Rules.

(b) A contestant may submit an Entry as an Individual Contestant and an Entry as part of a Group Contestant in accordance with Section 6(a) and these Rules.

7.Winner Selection

(a)Eligible Entries received during the Contest Period will be judged.

(b)Judging of the eligible Entries will be carried out from May 16, 2022 to June 7, 2022 in accordance with the following:

i.There will be (3) three judges for each Contestant Category of each Entry Category as follows:

ii.The judges will select the winning Entries on the following criteria:

A.Entry Categories:  Demonstrates an innovative and creative mindset, and creates a compelling vision for the future.

B.Vehicle Entry Category, Infrastructure Entry Category, and Expansion Entry Category:  Shows ideas that will potentially improve TTC’s processes, operations, and/or delivery of customer service.

C.Safety Entry Category:  Identifies opportunities and suggests improved health and safety of the workplace, and suggests changes that improve the health and safety of workers, customers, and/or the public. 

D.People Entry Category:  Promotes accessibility thoroughout the workplace for employees and customers, including recommendations for inclusive and accessible design for the removal of barriers, and contributes to an inclusive culture at TTC by valuing differences.

(c)The winning Entries will be the first (1st) and second (2nd) ranked Entries of each Contestant Category of each Entry Category for each of Individual Contestants and Group Contestants as determined by the judges.

(d)All decisions of the judges are final and binding.

(e)In or about June 8, 2022 (the “Selection Date”), each selected Individual Contestants and each contestant of the selected Group Contestants will be contacted by TTC using the information provided by contestant upon Entry and notified they have been selected.

(f)To be declared a winner, the selected Individual Contestant and each contestant of the selected Group Contestant must do the following:

i.Be in full compliance with these Rules.

ii.Within five (5) days of notification, sign and return a declaration and release prepared by TTC in which, among other things, contestant, (A) confirms compliance with these Rules; (B) agrees to release TTC and its board members (and their designates), officers, employees, consultants, and agents from any and all claims, damages, injuries, liabilities, costs, and expenses arising from any liability in connection with the Contest, and contestant’s participation in the Contest; (C) assigns all intellectual property, including copyright, in and to contestant’s Entry and waives contestant’s moral rights in the Entry in favour of TTC; (D) agrees to release TTC and its board members (and their designates), officers, employees, consultants, and agents against any and all claims, damages, liabilities, costs, and expenses arising from any use of contestant’s Entry, including without limitation, any claim that contestant’s Entry infringes a proprietary interest of any third party; (E) acknowledges acceptance of the Prize as awarded; (F) releases TTC and its board members (and their designates), officers, employees, consultants, and agents from any and all liability in connection with the awarding and/or contestant’s use or misuse of the Prize and any portion thereof; (G) agrees to the publication, reproduction and/or other use of contestant’s name as provided in the Entry and in accordance with these Rules, without further notice or compensation, in any publicity or marketing carried out by TTC in any manner whatsoever, including print, broadcast, or the internet; (H) agrees to be photographed and/or filmed in respect of the Contest, the Prize, and/or the Science Fair; and (I) agrees to the publication, reproduction, and/or other use of contestant’s photographed or filmed image in whole or in part, without further notice or compensation, in any publicity or marketing carried out by TTC in any manner whatsoever, including print, broadcast, or the internet, and waives contestant’s moral rights in contestant’s photographed and/or filmed image in whole or in part in favour of TTC.  If contestant is under the age of eighteen (18) years of age, contestant’s parent or guardian will need to sign and provide the declaration and release prepared by TTC.

iii.Within five (5) days of notification, provide TTC with the name of the winner’s guest and confirm that the guest has been notified that the guest will be required to sign a declaration and release prepared by TTC, in which, among other things, the guest, (A) agrees to release TTC and its board members (and their designates), officers, employees, consultants, and agents from any and all claims, damages, injuries, liabilities, costs, and expenses arising from any liability in connection with the Prize, and the guest’s participation and use of the Prize; (B) acknowledges that photographing and/or filming will be present throughout the Science Fair, and agrees to be photographed and/or filmed in respect of the Prize and/or the Science Fair; and (C) agrees to the publication, reproduction and/or other use of the guest’s photographed or filmed image in whole or in part, without further notice or compensation, in any publicity or marketing carried out by TTC in any manner whatsoever, including print, broadcast, or the internet.

(g)Should TTC be unable to contact the selected contestant within five (5) days of the Selection Date, the selected contestant is not in compliance with these Rules, the selected contestant fails to return the properly executed documents within the specified time, or the selected contestant fails to accept the Prize Pack for any reason, the selected contestant will be disqualified and will forfeit all rights to the Prize, and TTC reserves the right, in its sole and absolute discretion, to select the next ranked eligible Entry of the Contestant Category of the Entry Category for the Individual Contestant or Group Contestant, as applicable in accordance with these Rules, and in which case the foregoing provisions shall apply.

8.Winner Announcement

Winners, by first name and first initial of the last name provided by contestant upon Entry, will be announced on TTC’s public website on June 15, 2022.

9.The Prize

(a)A maximum of six hundred (600) prizes (each, a “Prize” and collectively, the “Prizes”) are available to be won.

(b)Each Prize consists of the following:

i.One (1) pack of TTC merchandize (the “Prize Pack”).
ii.One (1) entrance for the winner and one (1) entrance for a guest of the winner to participate in the TTC Science Fair scheduled for August 22, 2022 from 11:00 AM ET to 02:00 PM ET at Dundas Square (southeast corner of the intersection of Yonge Street and Dundas Street East in the City of Toronto).  The TTC Science Fair is presented by TTC to showcase and display to the public the winning Entries.

(c)The Prize Pack will be delivered to the the winner at the winner’s mailing address provided by contestant upon Entry. 

(d)Each winner and the winner’s guest are solely and absolutely responsible for transportation to and from the TTC Science Fair, including any costs applicable thereto.

(e)The approximate retail value of each Prize is no more than $100.00 CDN.

(f)The Prize is accepted by each winner as awarded and is not transferable, assignable, or convertible to cash, except as may be provided by TTC in its sole and absolute discretion.  No substitutions are permitted, except at TTC’s option in its sole and absolute discretion.

10.Prize Limitation

A contestant may only win one (1) Prize.

11.Release of Liability and Limitation of Liability

(a)By entering the Contest, each contestant (and contestant’s parent or guardian if contestant is under the age of eighteen (18) years of age on the Submission Deadline) accepts and agrees to, (a) be legally bound by these Rules, including the eligibility requirements; (b) be bound by the decisions of TTC and the judges; and (c) waives any and all claims against TTC and its board members (and their designates), directors, officers, and employees for any injury, damage, or loss that may occur, directly or indirectly, in whole or in part, from contestant’s participation or attempted participation in the Contest or from the receipt or use or misuse of a Prize or any travel activity related to the Science Fair.

(b)TTC shall not be responsible for incorrect or inaccurate transcription or registration of Entry information, technical malfunctions, lost or delayed data transmission, omission, interruption, deletion, defect, faulty, incomplete, incomprehensible, or erased computer or network transmissions, line failures of any telephone network, failure of computer equipment, software, inability to access any online service or web site, inability to enter the Contest by any error or malfunction, or an injury or damage to contestant’s or any other person’s computer related to or resulting from participation, submitting an Entry to the Email Portal.

(c)TTC shall not be responsible for any postal interruptions, any lost, stolen, mislaid, misplaces, or destroyed Entry in transit to the Mail Address, or any undelivered Entry sent to the Mail Address.

(d)TTC shall not be responsible for lost, stolen, illegible, or destroyed documentation in respect of the Prizes.

11.Consent to Publicity

By accepting a Prize, each winner authorizes TTC to use in any related publicity the winner’s name as provided in the Entry and in accordance with these Rules, photograph, image, likeness, voice, and any statements the winner may make regarding a Prize for TTC advertising and promotional purposes in perpetuity, in any form of media including the Internet, without limitation and without additional compensation or consideration, permission or notification, unless prohibited by law.

12.Laws and Rules

(a)The Contest will be run in accordance with these Rules, which shall be subject to amendment by TTC without notice or liability to contestants.  Each contestant must comply with these Rules and each contestant, and their parent or guardian if the contestant is under the age of eighteen (18) years of age, will be deemed to have read, understood, and agreed to, these Rules by submitting an Entry and participating in the Contest.

(b)The decisions of TTC in relation to the Contest will be final and binding on all contestants.

(c)The Contest is subject to all applicable federal, provincial, and municipal laws and regulations and is governed by the laws of the Province of Ontario and each contestant submits to the exclusive jurisdiction of the courts of the Province of Ontario in the City of Toronto.

13.Cancel and Amend

TTC reserves the right to cancel, modify, or suspend the Contest or to amend these Rules at any time in any way, without prior notice, for any reason whatsoever.  Without limiting the foregoing, if for any reason the Contest is not capable of running as originally planned, or due to technical failure, computer virus or bug, unauthorized human intervention, fraud or any other occurrence or cause beyond TTC’s control, TTC reserves the right to cancel or suspend the Contest.
